The Australian Energy Regulator (AER) performs economic regulation of the wholesale electricity market and electricity transmission networks in the National Electricity Market (NEM), and enforcement of the National Electricity Law and National Electricity Rules.
Originally established as a separate legal entity, and a constituent part of the ACCC, under Part IIIAA of the Trade Practices Act 1974. From 1 July 2026, AER became a standalone Non-Corporate Commonwealth Entity (NCE) for the purposes of the Public Governance, Performance and Accountability Act 2013, and a separate agency for the purposes of the Public Service Act 1999.
